These Terms and Conditions (“Terms”) govern your use of the Black Site Forge, LLC website (“Website”) and your purchase of firearms, ammunition, firearm parts and accessories, custom firearms, gunsmithing services, firearm transfers, and other products and services offered by Black Site Forge, LLC (“Black Site Forge,” “we,” “us,” or “our”).

By accessing this Website, submitting an order, purchasing a product or service, requesting a firearm transfer, or otherwise conducting business with Black Site Forge, you acknowledge that you have read, understood, and agree to these Terms.


1. LEGAL COMPLIANCE

Black Site Forge, LLC is a Federal Firearms Licensee (“FFL”) operating in Buckeye, Arizona.

All firearm transactions are subject to applicable federal, state, and local laws and regulations.

Nothing on this Website creates a right to purchase, receive, possess, manufacture, or transfer a firearm or other regulated product.

Black Site Forge reserves the right to refuse, cancel, delay, or terminate any transaction when we determine that completing the transaction could violate applicable law, regulations, licensing requirements, carrier requirements, or our compliance procedures.

If applicable law changes after an order is placed but before the transaction is completed, Black Site Forge will comply with the law applicable at the time the transaction occurs.


2. FIREARM SALES

Submitting an online firearm order or making payment does not guarantee that the firearm can ultimately be transferred to the purchaser.

Before a firearm can be transferred to an unlicensed purchaser, Black Site Forge must complete all legally required transfer procedures.

These procedures may include:

  • Verification of identity and identification documents;
  • Completion of ATF Form 4473;
  • Completion of a required background check;
  • Verification of residency and age;
  • Compliance with applicable federal and Arizona laws; and
  • Any additional procedures required by applicable law or Black Site Forge's compliance procedures.

Black Site Forge will transfer a firearm only to the person legally entitled to receive it.


3. PURCHASER RESPONSIBILITY

The purchaser is responsible for determining whether they are legally eligible to purchase, receive, and possess the firearm or ammunition being ordered.

By placing an order, the purchaser represents that:

  • All information provided is truthful and accurate;
  • The purchaser is legally eligible to receive and possess the product;
  • The purchaser is the actual intended purchaser unless the transaction is otherwise legally structured;
  • The purchaser will provide valid identification and documentation when required;
  • The purchaser will comply with all applicable laws; and
  • The purchaser will not attempt to use Black Site Forge to circumvent any firearm law or regulation.

Black Site Forge is not responsible for a purchaser's failure to satisfy applicable legal eligibility requirements.


4. STRAW PURCHASES AND FALSE INFORMATION

Black Site Forge will not knowingly participate in or facilitate straw purchases, unlawful transfers, fraudulent transactions, falsification of required records, or attempts to circumvent federal or state firearm laws.

A transaction may be refused or canceled if circumstances reasonably indicate that the transaction may be unlawful or inconsistent with required FFL procedures.

Providing false information on required federal forms may have serious legal consequences.


5. ONLINE AND INTERSTATE SALES

Black Site Forge may sell firearms to customers outside Arizona when the transaction can legally be completed.

Unless an applicable legal exception permits otherwise, an interstate firearm sale to an unlicensed purchaser will be shipped to an FFL located in the purchaser's state of residence for completion of the required transfer.

The receiving FFL must be willing and legally able to receive the firearm.

Black Site Forge is not responsible for delays caused by the receiving FFL, government agencies, background-check systems, shipping carriers, or other third parties.


6. RECEIVING FFL REQUIREMENTS

For transfers to another FFL, the purchaser is responsible for providing accurate receiving-FFL information.

Black Site Forge may require the receiving FFL to provide a valid FFL or other documentation necessary to verify the receiving licensee.

A firearm will not be shipped until Black Site Forge has completed the procedures it considers necessary to verify the receiving FFL and complete the transaction lawfully.


7. FIREARM TRANSFER FEE

Black Site Forge charges a $25 transfer fee per firearm for applicable firearm transfers.

The transfer fee applies to each firearm transferred unless a different fee is expressly agreed upon in writing.

Additional shipping, receiving-FFL, special-order, or other third-party charges may apply depending upon the transaction.

Transfer fees may be non-refundable once the applicable transfer service has been performed or the expense has been incurred.


8. BACKGROUND CHECKS

When a background check is required, Black Site Forge will follow applicable federal and state requirements.

A background-check result may include a Proceed, Delay, Deny, or other status recognized by the applicable system.

A delay does not necessarily mean that the purchaser has been approved.

A denied transaction will not be completed.

Black Site Forge may choose to wait for an affirmative Proceed response before completing a transfer where legally permitted.


9. AGE REQUIREMENTS

Black Site Forge will comply with applicable federal and state age restrictions governing firearms and ammunition.

Customers are responsible for meeting all applicable age requirements.

Black Site Forge may require additional identification or documentation when reasonably necessary to establish age or eligibility.


10. AMMUNITION

Ammunition sales are subject to applicable federal, state, and local laws and age restrictions.

Black Site Forge reserves the right to refuse an ammunition sale when required by law or when necessary to comply with applicable regulations or Company policy.

Customers are responsible for safely storing and using ammunition in accordance with the manufacturer's instructions.


11. USED AND PRE-OWNED FIREARMS

Used, pre-owned, consignment, and trade-in firearms may show evidence of previous use.

Normal wear, finish wear, scratches, handling marks, dents, discoloration, or other cosmetic imperfections do not necessarily constitute defects.

Black Site Forge will make reasonable efforts to accurately describe used firearms and provide photographs when appropriate.

Customers are encouraged to ask questions regarding condition before purchasing.


12. CUSTOM FIREARMS AND MANUFACTURING

Black Site Forge may provide custom firearm manufacturing, assembly, gunsmithing, machining, modification, refinishing, fitting, and related services.

Custom work may permanently alter a firearm or component.

Customers acknowledge that modifications may affect manufacturer warranty coverage, reliability, function, fit, finish, value, compatibility, or other characteristics of the firearm.

Black Site Forge will not knowingly perform work that violates applicable federal, state, or local law.

Custom work may require deposits or payment in advance and may become non-refundable once labor, machining, materials, or other work has begun.


13. GUNSMITHING SERVICES

Firearms submitted for gunsmithing remain the property of the customer unless otherwise agreed in writing.

Black Site Forge will exercise reasonable care in handling customer property.

Customers are responsible for accurately describing known problems or requested modifications.

Black Site Forge may refuse work when the firearm, component, requested modification, or circumstances present an unreasonable safety, legal, regulatory, or liability concern.


14. NFA FIREARMS

National Firearms Act (“NFA”) firearms and related transactions are subject to additional federal requirements.

Black Site Forge will not transfer or otherwise dispose of an NFA firearm unless all applicable federal requirements and approvals have been satisfied.

Customers are responsible for providing accurate information and completing documentation required for the applicable transaction.


15. SHIPPING

Firearms and regulated products will be shipped using methods Black Site Forge determines are appropriate and lawful for the specific product and destination.

Customers are responsible for providing accurate shipping and receiving-FFL information.

Once a shipment has been accepted by the carrier, carrier delays are outside Black Site Forge's direct control.

If a shipment arrives damaged, tampered with, or otherwise compromised, the customer or receiving FFL should preserve the packaging and contact Black Site Forge promptly.


16. PRODUCT DESCRIPTIONS

Black Site Forge makes reasonable efforts to ensure that product descriptions, photographs, prices, specifications, and availability are accurate.

Manufacturer specifications, finishes, configurations, packaging, and accessories may change without notice.

Photographs may be representative unless specifically identified as photographs of the exact firearm being sold.

Customers should contact Black Site Forge before purchasing if a particular feature or specification is essential to the purchase.


17. PRICING AND INVENTORY ERRORS

Black Site Forge reserves the right to correct pricing, inventory, product-description, and listing errors.

If a product is listed incorrectly because of an obvious pricing or inventory error, Black Site Forge may cancel the affected order and issue any applicable refund.


18. ORDER CANCELLATION

Black Site Forge may cancel an order when:

  • The product is unavailable;
  • The transaction cannot legally be completed;
  • The purchaser cannot complete required transfer procedures;
  • The receiving FFL cannot accept the firearm;
  • Payment cannot be successfully processed;
  • The order contains materially incorrect information;
  • Fraud or attempted fraud is suspected;
  • A straw purchase or other unlawful transaction is suspected;
  • A manufacturer or supplier cannot fulfill the order; or
  • Completion of the transaction would create a legal, regulatory, or licensing concern.

Refunds for canceled orders are subject to Black Site Forge's Return and Refund Policy.


19. WEBSITE USE

Users may not use the Website to:

  • Submit fraudulent information;
  • Attempt to circumvent firearm laws;
  • Purchase firearms for prohibited persons;
  • Interfere with Website security or operation;
  • Gain unauthorized access to Company systems;
  • Conduct fraudulent payment activity; or
  • Engage in unlawful activity.

20. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Black Site Forge shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from a transaction, product, service, shipping delay, transfer delay, inability to complete a transfer, or customer's use or misuse of a product.

Nothing in these Terms is intended to waive liability or rights that cannot legally be waived.


21. GOVERNING LAW

These Terms shall be governed by applicable federal law and the laws of the State of Arizona, except where federal law or another mandatory applicable law controls.


22. CHANGES TO THESE TERMS

Black Site Forge may modify these Terms from time to time.

Updated Terms will be posted on the Website with a revised effective date.

By placing an order or requesting services from Black Site Forge, you acknowledge that you have read and agree to these Terms and Conditions.

  • Withdraw and cancel services, and make financial transactions.
  • Manage customer expectations, such as liability for information errors or website downtime.
  • Explain your copyright rules, such as attribution, adaptation, commercial or non-commercial use, etc.
  • Set rules for user behavior, like forbidding unlawful behavior, hate speech, bullying, promotions, spam, etc.
  • Disable user accounts.
  • Write down any other terms or conditions that protect you or your audience.

Because firearms, ammunition, firearm parts, and related products are subject to federal and state laws, Black Site Forge, LLC (“Black Site Forge,” “we,” “us,” or “our”) handles returns and refunds differently from ordinary retail merchandise.

All firearm returns require prior authorization from Black Site Forge.

DO NOT SHIP OR DELIVER A FIREARM TO BLACK SITE FORGE WITHOUT FIRST CONTACTING US AND RECEIVING SPECIFIC RETURN INSTRUCTIONS.


1. GENERAL RETURN POLICY

Eligible non-firearm merchandise may generally be returned within 30 days of delivery.

Returned merchandise must generally be:

  • Unused;
  • In original or resalable condition;
  • Complete with all components and accessories;
  • Free from damage or modification; and
  • Accompanied by proof of purchase.

Certain products and services are subject to the additional restrictions described below.


2. FIREARMS NOT YET TRANSFERRED

A firearm that has been purchased but has not yet been legally transferred to the purchaser may be eligible for cancellation, subject to the circumstances of the transaction.

Customer-requested cancellations may be subject to a $15 restocking fee.

The customer may also be responsible for:

  • Shipping charges;
  • Transfer fees;
  • Special-order charges;
  • Supplier or manufacturer cancellation charges; and
  • Custom-work or gunsmithing charges already incurred.

The applicable refund will be calculated based upon the status of the transaction and expenses already incurred.


3. FIREARMS ALREADY TRANSFERRED

Firearms that have been legally transferred to the purchaser are not eligible for an ordinary retail return.

Once a firearm has been transferred, any subsequent return, replacement, repair, or disposition must comply with applicable federal and state law.

If a transferred firearm is believed to be defective, unsafe, or subject to a manufacturer warranty issue, the customer must contact Black Site Forge before shipping or delivering the firearm anywhere.

Black Site Forge will determine the appropriate lawful procedure for the particular situation.


4. BACKGROUND-CHECK DENIALS

If a customer is denied a required background check, Black Site Forge will not transfer the firearm to that customer.

The customer may be responsible for costs already incurred, including applicable:

  • $25 firearm transfer fees;
  • Shipping charges;
  • Restocking fees;
  • Administrative fees;
  • Receiving-FFL fees; and
  • Other transaction expenses.

Any eligible remaining balance will be refunded to the original payment method.

A background-check denial does not automatically entitle the purchaser to a full refund of every expense associated with the transaction.


5. BACKGROUND-CHECK DELAYS

A delayed background check is not an approval.

Black Site Forge will follow applicable federal requirements concerning delayed transactions.

Black Site Forge may elect to wait for an affirmative Proceed response before completing a transfer where legally permitted.

If the transaction ultimately cannot be completed, the applicable provisions of this Return and Refund Policy will apply.


6. CUSTOMER UNABLE TO COMPLETE TRANSFER

If a customer is unable to legally receive the firearm because of eligibility, identification, residency, required documentation, background-check status, state law, or another legal restriction, the firearm will not be transferred.

The customer may be responsible for applicable transaction expenses.

Any remaining eligible balance will be refunded according to this policy.


7. RECEIVING-FFL PROBLEMS

For interstate purchases, the customer is responsible for ensuring that the selected receiving FFL is willing and able to receive the firearm.

If the receiving FFL refuses the shipment, is unable to receive the firearm, has an invalid license, or otherwise cannot complete the transfer, the customer may be responsible for return shipping and other expenses.

Black Site Forge will work with the customer to determine an appropriate lawful disposition of the firearm.


8. WRONG ITEM OR SHIPPING ERROR

If Black Site Forge ships the wrong product, the customer should contact us as soon as possible.

If the error was caused by Black Site Forge, we will make reasonable efforts to correct the shipment at our expense.

Do not return a firearm without receiving instructions from Black Site Forge.


9. DAMAGED SHIPMENTS

Customers and receiving FFLs should inspect shipments promptly upon receipt.

If a package or product appears damaged:

  1. Photograph the package and product;
  2. Preserve all original packaging;
  3. Do not discard shipping materials;
  4. Contact Black Site Forge promptly; and
  5. Follow our instructions regarding inspection or carrier claims.

Failure to preserve packaging may interfere with a carrier claim.


10. DEFECTIVE FIREARMS

If a firearm appears defective, unsafe, or malfunctioning, stop using it and contact Black Site Forge.

Do not attempt unauthorized repairs or modifications before contacting us if you intend to pursue a warranty or defect claim.

Depending on the circumstances, Black Site Forge may:

  • Inspect the firearm;
  • Coordinate with the manufacturer;
  • Facilitate warranty service;
  • Arrange lawful return shipment;
  • Provide another lawful remedy; or
  • Determine that the issue is not covered by warranty.

Manufacturer warranty terms may apply.


11. USED AND PRE-OWNED FIREARMS

Used, pre-owned, consignment, and trade-in firearms are sold based upon their disclosed condition.

Normal wear and cosmetic imperfections are not considered defects.

Unless specifically stated otherwise in writing, used firearms are not subject to a general return period after transfer.

Customers should inspect available photographs and ask questions about condition before purchasing.


12. AMMUNITION

ALL AMMUNITION SALES ARE FINAL.

Ammunition may not be returned or exchanged except where required by law or when Black Site Forge specifically authorizes a return because of a verified fulfillment or manufacturer issue.

If ammunition arrives damaged, incorrectly shipped, or materially different from the order, contact Black Site Forge before using it.

Never use ammunition that appears damaged, defective, contaminated, or otherwise unsafe.


13. FIREARM PARTS AND ACCESSORIES

Unused firearm parts, accessories, optics, tools, and other eligible non-firearm merchandise may be returned within 30 days of delivery.

Returned products must be unused, undamaged, complete, and in resalable condition.

A $15 restocking fee may apply.

Installed, modified, damaged, altered, or used parts may be ineligible for return.

Products subject to manufacturer-specific return policies may be governed by those policies instead.


14. CUSTOM ORDERS

Custom orders are different from ordinary retail purchases.

Deposits and payments for custom firearms, custom machining, engraving, refinishing, fitting, modifications, special-order components, and other custom work may become non-refundable once work has begun or materials have been ordered.

Because custom products are made or modified specifically for the customer, cancellation may result in forfeiture of some or all amounts already paid.

The applicable cancellation terms will be disclosed before custom work begins.


15. GUNSMITHING SERVICES

Gunsmithing labor is generally non-refundable once the requested work has been performed.

If a customer changes their mind after work has begun, the customer remains responsible for labor and materials already incurred.

If Black Site Forge determines that requested work cannot safely or legally be completed, any unused portion of a prepaid amount will be addressed on a case-by-case basis.


16. NFA ITEMS

NFA firearms and related items are subject to additional federal requirements.

An NFA transaction may not be canceled, returned, or transferred merely because the purchaser changes their mind after regulatory processing has begun.

Any refund or cancellation involving an NFA item will be evaluated based on the status of the transaction, applicable law, manufacturer or supplier policies, and costs already incurred.


17. REFUNDS

Approved refunds will generally be issued to the original payment method.

Refunds may take several business days to appear depending upon the payment processor and financial institution.

The following may be deducted from a refund when applicable and legally permitted:

  • $15 restocking fee;
  • Shipping charges;
  • $25 firearm transfer fees;
  • Special-order charges;
  • Custom-work charges;
  • Gunsmithing labor;
  • Manufacturer or supplier fees;
  • Carrier charges; and
  • Other costs already incurred in connection with the transaction.

18. PAYMENT PROCESSING AND CHARGEBACKS

Customers should contact Black Site Forge before initiating a payment dispute or chargeback concerning a transaction.

Unauthorized or fraudulent chargebacks may be disputed using transaction records and other available documentation.

Nothing in this provision limits rights provided by applicable law.


19. NO UNAUTHORIZED FIREARM RETURNS

DO NOT SEND A FIREARM TO BLACK SITE FORGE WITHOUT PRIOR AUTHORIZATION.

Because firearms are regulated products, an unauthorized shipment may create legal, regulatory, shipping, and recordkeeping complications.

Contact Black Site Forge first so that we can determine the appropriate lawful procedure.


20. LEGAL REQUIREMENTS CONTROL

This Return and Refund Policy does not create a right to return, receive, possess, transfer, ship, or replace a firearm when doing so would violate applicable law.

If a provision of this policy conflicts with mandatory federal, state, or local law, the applicable law controls.

Do not ship a firearm until Black Site Forge has provided return instructions.
